Seeking Modifications to a Columbus Ohio Child Support, Custody or Spousal Support Order

Is it possible to seek modifications to a Columbus Ohio child support, child custody or spousal support (alimony) order?  There are many reasons to consider a post-decree modification to orders that were generated during your divorce or dissolution here in Central Ohio. In some cases, it may be as simple as the fact that a child has reached the age of majority, or has completed high school or even married or entered the military.  In other cases there may have been a substantial change in circumstances for one or both of the parties that requires revisiting child custody or support orders, or the payment of spousal support which may affect the amount of child support that is paid.

The original orders and agreements contained within the original divorce will have an impact on whether or not a court will hear a request for modification. Ohio courts are usually looking for a significant change in the circumstances of one or both of the parties.  Child custody and child support is generally not affected by a party’s remarriage, or cohabitation whether with person of the opposite sex or the same sex. A significant change in the “status quo” can include a substantial increase or decrease in income, the loss of a job, or other substantial financial changes.

Concerns about harmful developments such as domestic violence or substance abuse may also be grounds for a post-decree modification of support or custody orders. If one of the parties fails to comply with the orders issued by the court, a “contempt of court” action may be sought  to compel the former spouse who is in “default,” to comply with existing court orders.

Spousal support changes may be requested if the original court “retained jurisdiction” over the matter.  In some cases, spousal support orders are permanent and the court will not hear a motion for modification because the court did not retain jurisdiction to modify spousal support.
